LOVSPA provides an online destination for customers seeking premium home fragrance products. Our products may include reed diffusers, diffuser refills, reed diffuser sticks, and other home fragrance products offered through the Site.

Our goal is to provide high-quality, long-lasting, and beautifully designed fragrance products together with a simple and informative online shopping experience.

Orders and Cancellations

Orders may be cancelled before fulfillment where cancellation is reasonably possible.

Once an order has entered processing, fulfillment, or shipment, we may no longer be able to cancel or modify it.

LOVSPA may also cancel an order in certain circumstances, including but not limited to:

Indemnification

LOVSPA reserves the right, at its own expense, to assume control of the defense of a matter otherwise subject to indemnification by you. In such circumstances, you agree to reasonably cooperate with our defense.

Arbitration

To the extent permitted by applicable law, if LOVSPA and a user are unable to resolve a dispute arising from or relating to these Terms, the Site, or associated services, the dispute may be resolved through final and binding arbitration pursuant to the Federal Arbitration Act.

Arbitration will be conducted by a neutral arbitrator and may be administered by the American Arbitration Association or another mutually agreed arbitration service.

The location and procedures applicable to arbitration will be determined in accordance with the applicable arbitration rules and any agreement between the parties.

The arbitrator's decision will be final and binding, and judgment on an arbitration award may be entered in a court having appropriate jurisdiction.

The arbitrator will determine issues properly submitted to arbitration, including questions relating to the interpretation and enforceability of the arbitration provision where permitted by applicable law.

This arbitration provision is intended to survive termination of these Terms.

Nothing in this section is intended to limit rights that cannot legally be waived or restricted under applicable law.

Class Action Waiver

To the extent permitted by applicable law, arbitration or other claims arising under these Terms will be conducted on an individual basis.

Neither party may bring claims against the other as a plaintiff or member of a purported class, collective, or representative proceeding unless such restriction is prohibited by applicable law.

Unless otherwise agreed by the parties or required by law, an arbitrator may not consolidate claims belonging to multiple individuals or preside over a representative or class proceeding.

Liability Disclaimer

Nothing in these Terms excludes or restricts liability that cannot lawfully be excluded or restricted.

Termination and Access Restrictions

LOVSPA reserves the right, subject to applicable law, to suspend or terminate access to the Site or related services where reasonably necessary, including in cases of misuse, suspected fraud, unlawful activity, or violation of these Terms.

To the maximum extent permitted by law, these Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
